TERMS OF SERVICE
MAG.ONLINE — Online Payment Solutions OÜ
1. General Provisions
1.1 These Terms of Service ("Agreement") govern the use of the MAG.ONLINE platform ("Platform"), operated by Online Payment Solutions OÜ ("Company", "we", "us", or "our"), registered in Estonia under registration number 17449916.
1.2 By using the Platform, you ("User", "Client", or "Specialist") agree to comply with this Agreement. If you do not agree to the terms, please discontinue your use of the Platform.
1.3 The Platform provides an online marketplace connecting Clients seeking esoteric, astrological, psychological, and other advisory services with independent professionals ("Specialists" or "Mages").
1.4 The Company acts solely as an intermediary marketplace operator and is not a party to any service agreements between Clients and Specialists.
2. Definitions
- Platform — the MAG.ONLINE website
- Client — any registered user purchasing advisory services
- Specialist — any registered expert offering advisory services on the Platform
- Consultation — a paid session (video, audio, chat, or written) between a Client and a Specialist
- Booking — a confirmed reservation of a time slot for a Consultation
- MAG.ONLINE Credits — prepaid service units used to pay for services on the Platform (do not constitute electronic money)
- Service Fee — the Platform's fee retained from the Specialist's revenue
- Specialist Remuneration — the payment due to a Specialist for completed consultations
3. Registration Requirements
3.1 You must be at least 18 years of age to use the Platform.
3.2 By registering on the Platform, you confirm that the information you have provided is accurate, current, and complete.
3.3 Each user may hold only one account. Sharing of accounts is prohibited.
3.4 The Company reserves the right to require identity verification in accordance with applicable KYC/AML legislation.
4. MAG.ONLINE Credits System
4.1 What are Credits
MAG.ONLINE Credits are prepaid service units used exclusively to pay for consultations and services on the Platform. Credits do not constitute electronic money, currency, or a financial instrument.
4.2 Topping Up the Balance
Clients top up their Credits balance by depositing real funds through accepted payment methods. Various currencies are available (EUR, USD, GBP, UAH, and others). Deposited funds are converted into Credits at the rate set by the Platform.
4.3 Credits Restrictions
- Credits may ONLY be used to pay for services on the Platform
- Credits are NOT redeemable for cash
- Credits CANNOT be transferred to other users
- Unused Credits upon account closure may be refunded in cash upon request (subject to a minimum threshold)
4.4 Pricing
All service prices are displayed in MAG.ONLINE Credits. The Platform may display an approximate cash equivalent for reference purposes.
5. Payment Processing
5.1 All payments are processed through payment providers certified to PCI DSS Level 1, including Stripe, PayPal, and Adyen.
5.2 By making a payment, you authorise the Company to charge the agreed amount to your selected payment method.
5.3 The Company retains a service fee of 65% of the consultation fee. The Specialist receives 35% of the consultation fee.
5.4 Payment is charged at the time the booking is confirmed.
5.5 The Company does not store full card numbers. All payment data is processed by certified payment providers in accordance with PCI DSS standards.
6. User Responsibilities
6.1 Users are responsible for maintaining the security of their account credentials.
7. Marketplace Rules
7.1 For Clients:
- Clients may browse, book, and pay for consultations through the Platform
- Clients must treat Specialists with respect and refrain from harassment, insults, or threats
- Clients are responsible for the accuracy of information provided to Specialists
- Consultations are personal advisory in nature and do not constitute medical, legal, financial, or psychological assistance
7.2 For Specialists:
- Specialists must maintain accurate and truthful profiles, including name, photo, qualifications, areas of expertise, and pricing
- Specialists are independent contractors and not employees, agents, or representatives of the Company
- Specialists bear sole responsibility for the accuracy and quality of their services
- Specialists must comply with all applicable laws when providing their services
- Specialists must not offer services that are unlawful, fraudulent, or harmful
7.3 Prohibited Conduct and Content:
- Spamming, unsolicited communications, or soliciting Clients outside the Platform
- Misrepresentation of qualifications or services
- Unauthorised data collection or privacy violations
- Any form of discrimination, harassment, or hate speech
8. Specialist Remuneration
8.1 Specialists receive remuneration of 35% of the fee for each completed consultation as payment for services rendered.
8.2 Payouts are made weekly upon reaching the minimum threshold of EUR 10.00.
8.3 Payout methods:
- Bank transfer (SEPA)
- PayPal
- Stripe Connect
8.4 Specialists bear sole responsibility for declaring and paying taxes on remuneration received.
9. Cancellation Policy
9.1 Clients may cancel a booking with a full Credits refund provided the cancellation is made more than 24 hours before the start of the session.
9.2 Cancellation between 12 and 24 hours before the session entitles the Client to a 50% Credits refund.
9.3 Cancellation less than 12 hours before the session or a Client no-show entitles the Client to no refund.
9.4 A Specialist who fails to attend a confirmed booking without giving 24 hours' notice is obliged to provide the Client with a full Credits refund. Repeated no-shows may result in the Specialist's account being suspended.
10. Intellectual Property
10.1 All Platform content, including software, design, text, and trademarks, belongs to or is licensed by Online Payment Solutions OÜ.
10.2 Users are granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with this Agreement.
10.3 Users may not reproduce, distribute, or create derivative works based on Platform content without explicit written permission.
11. Limitation of Liability
11.1 The Platform is provided "as is". The Company makes no warranties regarding continuous operation, absence of errors, or fitness for a particular purpose.
11.2 The Company bears no liability for the content or outcomes of consultations provided by Specialists.
11.3 The Company's total liability to any user shall not exceed the amount paid by that user to the Platform in the preceding 12 months.
11.4 The Company bears no liability for indirect, incidental, special, or punitive damages.
12. Privacy and Data Protection
12.1 The processing of personal data is governed by the Privacy Policy, which forms an integral part of this Agreement.
12.2 By using the Platform, you agree to the processing of data in accordance with the Privacy Policy and GDPR (EU 2016/679).
13. Amendments to the Agreement
13.1 The Company reserves the right to amend this Agreement. Material changes take effect 30 days after notification.
13.2 Continued use of the Platform after the amendments take effect constitutes acceptance of the updated terms.
14. Governing Law and Dispute Resolution
14.1 This Agreement is governed by Estonian law.
14.2 Disputes shall be resolved by Estonian courts, unless otherwise provided by applicable EU law.
14.3 EU consumers are entitled to contact their local consumer protection authority or use the EU Online Dispute Resolution Platform: ec.europa.eu/consumers/odr.
